SafeNSound LLC (“SafeNSound,” “we,” “us,” or “our”) provides this Privacy Notice to describe how we collect, use, disclose, and protect information when you access or use the SafeNSound website, mobile application, or any related services (collectively, the “Service”). By using the Service, you acknowledge that you have read and understand this Privacy Notice.
1. Information We Collect
1.1 Information Collected Automatically
When you access or use the Service, we automatically collect certain technical information, including:
- Network and device identifiers: Your Internet Protocol (IP) address, device type, operating system and version, browser type and version, and unique device identifiers.
- Usage data: Pages viewed, search queries performed within the Service, map interactions (zoom level, geographic area viewed), date and time of access, session duration, and referring URL.
- Approximate geolocation: General geographic location derived from your IP address (city/region level; we do not collect precise GPS coordinates unless you grant explicit permission for location-based features).
- Log data: Server logs recording access requests, error reports, and system activity for security monitoring.
1.2 Cookies and Similar Technologies
We use strictly necessary cookies to maintain session state and ensure the Service functions properly. We do not use advertising cookies, social media tracking pixels, or cross-site behavioral tracking technologies. If we change this practice in the future, we will update this Privacy Notice and provide appropriate notice and choice.
1.3 Information We Do NOT Collect
We do not require account creation to use the Service. We do not collect your name, email address, phone number, physical address, payment information, or other directly identifying personal information unless you voluntarily provide it (for example, when contacting us). We do not collect biometric data. We do not create user profiles for advertising purposes.
2. How We Use Your Information
We use the technical information collected through the Service for the following purposes:
- Security and abuse prevention: Detecting and preventing unauthorized access, fraud, abuse, and misuse of the Service, including violations of our Terms of Use (particularly the prohibited conduct provisions).
- Service integrity: Maintaining, troubleshooting, and improving the performance, reliability, and availability of the Service.
- Legal compliance: Complying with applicable laws, regulations, and legal process.
- Aggregated analytics: Generating aggregated, de-identified statistics about Service usage to understand usage patterns and improve the Service. Aggregated data cannot be used to identify any individual user.
We do not use your information for advertising, marketing, user profiling, or any purpose unrelated to the operation and security of the Service.
3. How We Share Your Information
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. We share personal information only in the following limited circumstances:
3.1 Service Providers
We may share technical data with a limited number of service providers who assist us with hosting, infrastructure, security monitoring, and analytics, solely to the extent necessary for them to perform services on our behalf. These providers are contractually obligated to use your information only for the purposes for which it was disclosed and to maintain its confidentiality.
3.2 Legal Process and Law Enforcement
We may disclose your personal information to government authorities or law enforcement officials when we believe in good faith that such disclosure is necessary or appropriate to:
(a) Comply with a legal obligation, including responding to a valid subpoena, court order, search warrant, or other lawful request issued by a public authority with competent jurisdiction;
(b) Protect the safety of any person, including situations involving imminent danger of death or serious physical injury;
(c) Protect and defend the rights or property of SafeNSound; or
(d) Protect against legal liability.
We evaluate all requests for user information to ensure they are legally valid and appropriately scoped.
We may challenge or seek to narrow requests that we determine are overbroad, vague, or legally deficient. Where permitted by law and where we are not prohibited by court order or other legal restriction, we will make reasonable efforts to notify affected users before disclosing their information in response to legal process.
We do not voluntarily provide user data to any government agency absent valid legal process, except in genuine emergency circumstances involving imminent danger of death or serious physical injury.
3.3 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of SafeNSound's assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy notice.
3.4 With Your Consent
We may share your information for purposes not described in this Privacy Notice if we obtain your explicit consent.
4. Data Retention
We retain IP address logs and associated technical data for ninety (90) days from the date of collection for security and abuse prevention purposes. After this period, the data is either deleted or irreversibly anonymized.
Aggregated, de-identified analytics data that cannot be used to identify any individual may be retained indefinitely.
If we receive a valid legal preservation request from a law enforcement agency, we may retain specific records for an extended period as required by law, typically not to exceed 90 days per request (subject to renewal).
5. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of your information. These measures include encrypted data transmission (TLS/SSL), access controls, and regular security monitoring.
No method of transmission over the Internet or method of electronic storage is 100% secure.
While we strive to protect your information, we cannot guarantee its absolute security. We do not guarantee that unauthorized access, disclosure, alteration, or destruction of data will never occur.
6. Your Privacy Rights
Depending on your jurisdiction of residence, you may have certain rights regarding your personal information. We honor the following rights to the extent required by applicable law:
6.1 All Users
You may contact SafeNSound to request:
- Access to the categories of personal information we have collected about you;
- Deletion of personal information we have collected about you, subject to certain legal exceptions;
- Information about our data collection and sharing practices.
6.2 California Residents
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (Cal. Civ. Code § 1798.100 et seq.), including the right to know, delete, and correct your personal information, and the right to opt out of the sale or sharing of personal information. We do not sell or share your personal information as those terms are defined under the CCPA/CPRA.
Under the California Online Privacy Protection Act (Cal. Bus. & Prof. Code § 22575 et seq.), we disclose our data practices in this Privacy Notice.
“Do Not Track” Signals. The Service does not currently respond to “Do Not Track” browser signals because there is no industry-standard protocol for interpreting such signals. We do not engage in cross-site tracking.
6.3 Virginia, Colorado, Connecticut, and Other State Residents
If you are a resident of Virginia, Colorado, Connecticut, Delaware, New Hampshire, New Jersey, Nebraska, Oregon, Montana, Texas, Indiana, Kentucky, Rhode Island, or another state with a comprehensive consumer data privacy law, you may have rights to access, correct, delete, and obtain a copy of your personal data, and to opt out of certain processing activities. Because we do not sell personal data, process data for targeted advertising, or engage in profiling that produces legal or similarly significant effects, the opt-out rights under these laws are generally not applicable to our processing activities.
If you wish to exercise any of the rights described above, please contact us using the information in Section 10. We will respond to verifiable requests within the timeframe required by applicable law (typically 45 days).
Right to Appeal. If we decline to take action on your request, you have the right to appeal our decision. We will provide instructions for submitting an appeal in our response to your request.
7. Information About Registered Individuals
The sex offender registry data displayed through the Service is publicly available government information obtained from official state, territorial, tribal, and federal registries. This data is public record made available by government agencies pursuant to federal law (Sex Offender Registration and Notification Act, 34 U.S.C. § 20901 et seq.) and state Megan's Law statutes for the purpose of public safety.
SafeNSound does not create, verify, or control registry data.
We are not responsible for the accuracy, completeness, or timeliness of information maintained by government registries. Individuals with questions about their inclusion in a sex offender registry should contact the relevant government agency directly.
SafeNSound does not cross-reference, correlate, or combine user activity data (such as searches or map views) with sex offender registry data for any purpose. We do not publicize or share information about which registry entries any user views.
8. Children's Privacy
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly. If you believe a child under 18 has provided personal information to SafeNSound, please contact us using the information in Section 10.
9. Changes to This Privacy Notice
We may update this Privacy Notice from time to time to reflect changes in our practices, applicable law, or for other operational or legal reasons. When we make material changes, we will update the “Last Updated” date at the top of this Notice and, where practicable, provide notice through the Service. Your continued use of the Service after the posting of any updated Privacy Notice constitutes your acceptance of the updated Notice.
We encourage you to review this Privacy Notice periodically.
